These Terms and Conditions ("Terms") govern your access to and use of premadhvani.net (the "Site") and any services offered through it, including Mṛdaṅga Vidyā instruction, Kartāl Sādhanā instruction, and Vraja Maṇḍala Darśana guidance (collectively, the "Services"). The Services are offered by Manfred Mong'are, also known by his initiated spiritual name Manaḥśikṣā dāsa, operating as an individual sole proprietor under the name "Prema Dhvani" ("Prema Dhvani," "we," "us," "our").
By accessing the Site, submitting a form, booking a conversation, or purchasing any Service, you ("you," "student," "client") agree to be bound by these Terms. If you do not agree, do not use the Site or Services.
1. Nature of the Services
Prema Dhvani offers private instruction in mṛdaṅga and kartāl within the Gauḍīya Vaiṣṇava devotional tradition, and guided darśana/pilgrimage experiences in Vraja Maṇḍala. These Services are offered in a devotional and educational context.
These Services are not:
- A substitute for formal spiritual initiation (dīkṣā) or a relationship with an authorized guru
- Professional medical, psychological, legal, or financial advice
- A guarantee of any specific skill outcome, spiritual attainment, or experience
You engage with the Services voluntarily and at your own discretion.
2. Eligibility
You must be at least 18 years old to independently purchase or enroll in the Services. If you are under 18, a parent or legal guardian must review these Terms, consent on your behalf, and take responsibility for all payment, communication, and safety matters.
3. Enrollment, Pricing, and Billing
- Current pricing and tier structures are listed on the relevant service pages and are subject to change at our discretion. Changes will not retroactively affect an already-active billing cycle.
- Subscription tiers are billed monthly, in advance, via our designated payment processor. By purchasing, you authorize recurring charges until you cancel.
- Certain tiers carry a stated minimum commitment period (e.g., 2 or 3 months, as published on the relevant service page). You are responsible for the full minimum commitment once enrolled, regardless of session attendance.
- Limited-enrollment tiers (e.g., Paramparā Sevā) are offered subject to availability and our discretion to accept or decline any applicant.
4. Payments
All payments are processed through a third-party payment processor. We do not store your full payment card details. You are responsible for ensuring your payment method remains valid and funded for recurring billing. Failed payments may result in suspension of access until resolved.
5. Cancellations and Refunds
- You may cancel your subscription at any time for future billing cycles by notifying us through the Site's contact channels.
- All refunds are issued solely at our discretion, evaluated case-by-case. No refund is guaranteed for any payment already processed, including partial months, missed sessions, or early cancellation within a minimum-commitment period.
- Rescheduling of missed sessions is subject to instructor availability and is not guaranteed.
6. Vraja Maṇḍala Darśana — Additional Terms
Because this Service involves physical travel, transport, and site visits in India:
- Assumption of Risk. Travel, pilgrimage, and parikramā activities carry inherent risks, including but not limited to physical injury, illness, accident, theft, weather, and third-party transport or accommodation providers outside our direct control. By participating, you voluntarily assume these risks.
- Third-Party Providers. Where transport, accommodation, or other logistics are arranged via third parties, Prema Dhvani acts as a guide and coordinator only and is not liable for the acts, omissions, or service quality of independent third-party providers.
- Health and Fitness. You are responsible for assessing your own physical fitness to participate and for disclosing any relevant health conditions in advance.
- Personal Documents and Compliance. You are solely responsible for your own visa, travel documents, insurance, and compliance with Indian law during your visit.
- We strongly recommend obtaining independent travel insurance before participating in any darśana experience.
7. Intellectual Property
All teaching materials, notation sheets, mantra documentation, session recordings, written records, site content, branding, and related materials provided through the Services are the intellectual property of Prema Dhvani / Manfred Mong'are, except where explicitly noted as third-party or traditionally sourced material (e.g., traditional mantras, praṇāma verses).
You may use materials provided to you for your own personal practice only. You may not reproduce, redistribute, resell, publicly republish, or use these materials commercially without our prior written consent.
8. Communication Consent
By providing your phone number or engaging via WhatsApp, you consent to receive service-related communication through that channel, including scheduling, corrections, and administrative messages. You may opt out of non-essential communications at any time.
9. Conduct
You agree to engage with instructors, guides, and any group participants respectfully and in a manner consistent with the devotional context of the Services. We reserve the right to decline service, suspend, or terminate access to any individual whose conduct is abusive, disruptive, or inconsistent with the spirit of the Services, without refund obligation beyond what is required by Section 5.
10. Disclaimers
The Services are provided "as is" and "as available." We make no warranties, express or implied, regarding outcomes, results, or fitness for a particular purpose. Spiritual, musical, and pilgrimage progress depends on your own practice, sincerity, and circumstances beyond our control.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Prema Dhvani and Manfred Mong'are shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the Site or Services. Our total aggregate liability for any claim arising from the Services shall not exceed the amount you paid to us in the three (3) months preceding the claim.
Nothing in these Terms excludes liability that cannot be excluded under applicable law (e.g., liability for death or personal injury caused by gross negligence, where such exclusion is not permitted).
12. Indemnification
You agree to indemnify and hold harmless Prema Dhvani and Manfred Mong'are from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your violation of these Terms, your misuse of the Services, or your participation in travel/darśana activities.
13. Third-Party Links
The Site may reference or link to third-party services (e.g., WhatsApp, payment processors, scheduling tools). We are not responsible for the content, policies, or practices of these third parties.
14. Changes to the Services or Terms
We may modify, suspend, or discontinue any part of the Services, and may update these Terms, at our discretion. Continued use of the Site or Services after changes are posted constitutes acceptance of the revised Terms. Material changes affecting active subscribers will be communicated where reasonably practicable.
15. Termination
We may suspend or terminate your access to the Services at our discretion, including for breach of these Terms, non-payment, or conduct inconsistent with Section 9. You may terminate your enrollment at any time per Section 5.
16. Governing Law and Disputes
These Terms are governed by and construed in accordance with the laws applicable to the operator, Manfred Mong'are, a Kenyan national, and any dispute arising from these Terms or the Services shall be resolved with reference to Kenyan law and, where jurisdiction is contested, submitted to the courts of Kenya, without prejudice to any mandatory consumer protections you may hold under your own local law.
17. Force Majeure
We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to illness, travel restrictions, natural disasters, political unrest, or platform/technology outages.
18. Entire Agreement; Severability
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Prema Dhvani regarding the Services. If any provision is found unenforceable, the remaining provisions remain in full effect.
